All appointments, estimates, and consultations are subject to availability and must be scheduled in advance. By scheduling, you agree to provide accurate contact and property information, ensure site access is available at the scheduled time including any required permits or utility clearances, and understand that arrival windows are estimates subject to field conditions. If site access is unavailable at the time of a scheduled visit, Masterson Paving reserves the right to reschedule and may assess a trip charge. Masterson Paving reserves the right to decline or reschedule any appointment at its sole discretion.
Cancellations must be made at least 48 hours in advance. Cancellations with less than 48 hours notice may result in rescheduling delays or loss of scheduling priority. No shows without prior notice may forfeit your scheduling slot. Masterson Paving may also cancel or reschedule due to weather, safety concerns, equipment issues, or circumstances beyond our control. Because paving and sealcoating depend heavily on weather and temperature, rescheduling is sometimes unavoidable. All services are governed by a written or verbal scope of work agreed upon before project commencement. Services will be performed only as described in that agreed scope. Any additional work requires a separate agreement. Masterson Paving is not responsible for pre existing site conditions, subsurface hazards, undisclosed utilities, drainage issues, or pre existing damage unless identified during a formal site assessment. Permits, zoning compliance, and environmental requirements are the customer’s responsibility unless otherwise agreed in writing. Masterson Paving reserves the right to halt or modify work if unsafe conditions are discovered on site. Nothing on this Site constitutes a binding service agreement or contract. All commitments must be confirmed in writing.
MASTERSON PAVING PROVIDES THIS SITE AND ALL SERVICES “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON INFRINGEMENT. Any workmanship warranty offered applies only as described in your written agreement and does not cover normal wear, weather damage, ground movement, or lack of proper maintenance. Asphalt naturally settles and changes over time, which is expected and not considered a defect. If unresolved, disputes shall be submitted to binding arbitration under AAA rules in Providence County, Rhode Island, decided by a single arbitrator whose decision is final and binding. Either party may seek injunctive relief in court to prevent irreparable harm. Small claims court rights are not waived.
